FREQUENTLY ASKED QUESTIONS

How much does a personal injury lawyer cost?
Many personal injury lawyers work on a contingency-fee basis, meaning you generally do not pay attorneyโ€™s fees unless your case results in a recovery. The fee and case costs depend on your agreement with the attorney.
What types of compensation can I recover?
Depending on your case, you may be able to recover compensation for medical expenses, lost wages, property damage, pain and suffering, and other losses related to your injury.
How long do I have to file a claim in Florida?
Florida generally gives you two years to file a negligence claim, although exceptions can apply depending on the circumstances. Claims involving government entities can have additional requirements.
How long will my case take?
Every case is different. Some personal injury claims settle in a matter of months, while cases involving serious injuries, disputes over liability, or a trial can take longer.
What if I was partially at fault?
You may still be able to recover compensation if you were partially at fault. Florida generally reduces damages based on your percentage of fault, but you cannot recover damages if you are found more than 50% at fault in most negligence cases.
Do I have to talk to the insurance company?
You should be careful when speaking with an insurance company after an accident. You are not required to accept a settlement simply because an insurer makes an offer, and an attorney can handle communications on your behalf.
Will my case go to trial?
Not necessarily. Many personal injury cases are resolved through settlement. If the parties cannot reach an agreement, however, your case may proceed to trial.
Can I still recover if the accident was caused by a government entity?
You may be able to pursue a claim against a government entity, but special rules, notice requirements, deadlines, and damage limits can apply.
