In divorce there are two main types of divorce Contested and Uncontested divorce.

Uncontested Divorce
This type of divorce is what most people think they can get done. This type of divorce is where both parties agree to the terms of the divorce before filing. It requires very few court appearances, costs a smaller amount of money and is over pretty quickly. However, as Attorney Bernstein always tells clients “If you could agree on things, you probably wouldn’t be filing for divorce”. While some parties are able to file uncontested divorces, communication usually breaks down when we start talking money, dividing assets, child support, alimony, etc. If one partner is hiring an attorney, the other needs to as well, because it probably won’t be an uncontested divorce.

Contested Divorce

The more common type of divorce happens when both sides do not agree on how to split assets, child custody, alimony, etc. The process starts when one party files a Petition for Dissolution of Marriage, and serves their spouse. When served with a Petition, the other party then has 20 days to respond to said Petition. It is important if you are served with a Petition, you should reach out to Bernstein Law immediately to start preparing your response and counter petition.
